1. Scope, Acceptance, and Applicability
These Website, Mobile, Electronic Communications, Privacy, and Payment Terms and Conditions (“Terms”) govern your access to and use of any website, customer portal, mobile application, text messaging program, push notification service, electronic communication channel, online payment service, claim-related digital service, electronic signature process, paperless delivery option, or other digital platform or service made available by Granwest Insurance, including Granwest Mutual Holding Company, Granwest Intermediate Holding Company, Granwest Insurance Company (formerly Grange Insurance Association), Granwest Property & Casualty, and their affiliated insurance companies and service operations, as applicable (collectively, “Granwest Insurance,” “Granwest,” “we,” “our,” or “us”).
By accessing, browsing, registering for, downloading, enabling, submitting information through, making a payment through, communicating through, or otherwise using any Granwest website, mobile application, customer portal, payment platform, claim service, text messaging program, electronic signature process, or related digital service, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to applicants, policyholders, insureds, claimants, payees, website visitors, mobile application users, authorized representatives, business partners, service providers, and any other person who accesses or uses our digital services.
These Terms are intended to operate as a single consumer-facing document that includes our general website and digital service terms, our electronic communications and E-SIGN terms, our mobile application and SMS/text messaging terms, our online payment terms, our claim payment and direction-to-pay terms, and our privacy notice. These Terms also describe how we collect, use, disclose, retain, safeguard, and otherwise process Personal Information and Nonpublic Personal Information in connection with our insurance operations, digital services, customer communications, billing and payment functions, claim services, and legal and regulatory obligations.
These Terms do not amend, modify, replace, expand, or reduce the terms, conditions, exclusions, limitations, payment obligations, cancellation provisions, nonrenewal provisions, claim requirements, or other obligations contained in any insurance policy, billing statement, installment plan, notice, endorsement, application, claim communication, settlement document, or other agreement issued by Granwest. Your insurance policy, applicable notices, and governing law control your rights and obligations as an applicant, insured, policyholder, claimant, or payee.
2. United States Operations and Availability of Services
Granwest is a United States-based insurance company. Our insurance products, claims services, billing functions, payment services, and digital services are designed for individuals, businesses, insured risks, transactions, and claims located within the United States. If you access our websites, mobile applications, portals, or other digital services from outside the United States, you do so voluntarily and are responsible for compliance with any applicable local laws. We do not represent that our services are appropriate, available, or lawful for use in every jurisdiction.
Our websites, mobile applications, customer portals, payment systems, claim tools, electronic communication channels, and related digital services may not always be available, current, uninterrupted, secure, or error-free. We may add, modify, suspend, restrict, or discontinue any service, feature, functionality, payment method, claim tool, communication channel, or digital platform at any time, subject to applicable law. Information displayed through a website, mobile application, portal, payment screen, claim tool, or digital service may not reflect the most current status of your policy, claim, payment, bill, account, notice, or transaction. Official policy documents, billing notices, claim communications, statutory notices, and applicable law govern your rights and obligations.
3. Relationship to Insurance Policies, Claims, Billing, and Legal Rights
Digital services are provided for convenience and to support policy administration, billing, claim handling, customer service, communications, and related operations. Nothing shown, transmitted, estimated, recommended, calculated, displayed, or confirmed through a digital service creates, changes, waives, or guarantees insurance coverage, claim payment, policy status, premium amount, cancellation status, nonrenewal status, reinstatement, renewal, eligibility, underwriting outcome, or settlement amount unless Granwest expressly confirms that result in an official policy document, claim communication, billing document, or other written notice authorized by Granwest.
Submitting information, making a payment, uploading photos, using a claim tool, authorizing a direction to pay, communicating electronically, or receiving a digital confirmation does not guarantee that coverage is bound, continued, reinstated, renewed, or maintained. Coverage remains subject to the terms of the applicable insurance policy, underwriting requirements, payment requirements, claim requirements, and applicable law. A payment submitted after cancellation, lapse, expiration, nonrenewal, or other termination of coverage may not reinstate coverage unless Granwest expressly confirms reinstatement or continuation in accordance with the policy and applicable law.
4. Ownership, Intellectual Property, and Restrictions on Use
The websites, mobile applications, customer portals, payment systems, claim tools, content, graphics, images, text, software, data, product information, service information, forms, documents, designs, interfaces, trademarks, logos, and other materials made available through Granwest digital services are owned by Granwest, its affiliates, licensors, vendors, or other third parties and are protected by applicable intellectual property and proprietary rights laws.
You may access and use Granwest digital services solely for lawful, personal, non-commercial purposes related to your relationship with Granwest or your authorized interaction with our services. You may download or retain copies of documents, confirmations, records, or materials made available to you for your own personal, policy, billing, claim, or recordkeeping purposes, provided that you do not remove copyright, trademark, proprietary, or other notices. Except as expressly permitted by Granwest in writing, you may not copy, modify, distribute, display, reproduce, reverse engineer, decompile, disassemble, transmit, sell, license, exploit, interfere with, scrape, bypass, or misuse any website, mobile application, platform, service, software, content, or functionality.
5. User Accounts, Credentials, and Contact Information
Certain services may require you to create or use a user account. By creating or using an account, you agree to provide accurate, current, and complete information and to maintain the confidentiality and security of your username, password, credentials, payment information, device, and account access. You are responsible for activity conducted through your account or using your credentials unless and until you notify us of unauthorized activity and we have a reasonable opportunity to respond.
You agree to promptly update your email address, mailing address, telephone number, mobile number, payment information, account information, and other contact information if it changes. We are not responsible for your failure to receive communications, notices, confirmations, alerts, or records if you do not maintain accurate contact information, if your email provider blocks or filters communications, if your device settings block notifications, if your mobile carrier delays or blocks messages, or if your device, account, network, or system is unavailable.

Recipients of Nonpublic Personal Information are subject to limits on redisclosure and reuse where required by GLBA and state insurance privacy laws. Service providers that process information on our behalf are expected to use information only for authorized purposes and are subject to contractual, legal, or operational restrictions appropriate to the nature of the services provided and the information involved.
7. GLBA and State Insurance Privacy Notice
This section is intended to satisfy applicable notice requirements under GLBA and state insurance privacy laws, including requirements applicable to nonpublic personal financial information and, where applicable, nonpublic personal health information.
We collect Nonpublic Personal Information from consumers, transactions with us, transactions with affiliates or third parties, consumer reporting agencies, insurance-support organizations, motor vehicle records providers, agents, brokers, claim sources, payment processors, public records, and service providers.
We disclose Nonpublic Personal Information for everyday business purposes permitted by law, including to process transactions, maintain accounts, administer policies, service claims, prevent fraud, comply with legal obligations, respond to court orders and legal investigations, report to consumer reporting agencies where permitted, and support insurance operations.

We do not disclose Nonpublic Personal Information to nonaffiliated third parties in a manner that requires a GLBA or state insurance privacy opt-out unless we first provide any required initial notice, opt-out notice, reasonable opportunity to opt out, and revised notice required by applicable law. If our practices change in a way that creates an opt-out right under GLBA or applicable state insurance privacy law, we will provide the required notice and opportunity to opt out before applying the change to affected information.
We maintain administrative, technical, and physical safeguards designed to protect Nonpublic Personal Information. These safeguards are intended to support the confidentiality, integrity, availability, and resiliency of our systems and information and to align with applicable GLBA Safeguards Rule obligations, state insurance information security requirements, and other applicable privacy and cybersecurity laws.
Disclosures of Nonpublic Personal Information are made in accordance with GLBA, state insurance privacy laws, and other applicable legal requirements. These disclosures generally include sharing for everyday insurance business purposes such as underwriting, policy servicing, claims handling, fraud prevention, legal compliance, and operational support. Where disclosure practices would require an opt-out right under applicable law, Granwest will provide the required notice and opportunity to opt out.
8. California Privacy Notice
This section applies to California residents to the extent CCPA/CPRA or California insurance privacy laws apply. Certain insurance-related information may be subject to exemptions or separate requirements under GLBA, the Fair Credit Reporting Act, California insurance privacy laws, or other laws. We will honor applicable California privacy rights unless an exemption, exception, legal limitation, or insurance-specific requirement applies.
At or before the point of collection, we disclose the categories of Personal Information we collect, the purposes for which we collect or use that information, whether we sell or share that information, and the retention period or criteria used to determine retention. The categories of Personal Information we collect and the purposes for collection, use, disclosure, and retention are described in this Privacy Notice.
California residents may have the right to know or access the categories and specific pieces of Personal Information we collected about them, the right to know categories of sources, purposes, categories of third parties, and categories of information disclosed, sold, or shared, the right to delete certain Personal Information, the right to correct inaccurate Personal Information, the right to data portability, the right to opt out of sale or sharing of Personal Information, the right to limit use and disclosure of Sensitive Personal Information where applicable, the right to non-discrimination for exercising privacy rights, and the right to use an authorized agent subject to verification and proof of authority.

If Granwest begins selling or sharing Personal Information as defined by California law, or begins using Sensitive Personal Information in a manner that requires a right to limit, we will update this Privacy Notice, provide any required “Do Not Sell or Share My Personal Information” or “Limit the Use of My Sensitive Personal Information” mechanism, honor opt-out preference signals where required, and update contracts and cookie controls before the practice begins.
California residents involved in insurance transactions may also have rights to access, request correction, or obtain reasons for certain adverse underwriting decisions under California insurance privacy laws and related insurance requirements. Requests may be submitted using the methods described in the “How to Submit Privacy Requests” section of this Privacy Notice.
9. Colorado Privacy Notice

We do not sell Personal Data, process Personal Data for targeted advertising, or use profiling in furtherance of decisions that produce legal or similarly significant effects unless disclosed in this Privacy Notice and supported by required opt-out mechanisms. Where required and technically feasible, we recognize legally required universal opt-out mechanisms, including Global Privacy Control, for applicable opt-out rights.
If we deny a Colorado privacy request and Colorado law provides an appeal right, you may appeal by contacting us using the same request methods and stating that you are submitting a Colorado privacy appeal. If we deny the appeal, we will provide information about how to contact the Colorado Attorney General as required by law.
10. Oregon Privacy Notice
This section applies to Oregon residents to the extent the Oregon Consumer Privacy Act (“OCPA”) applies. Certain Personal Data and processing activities may be exempt from OCPA, including information processed in connection with insurance transactions.
Personal Data processed in connection with underwriting, policy administration, billing, claims handling, fraud prevention, and related insurance operations may be exempt from OCPA to the extent such data is subject to the Gramm-Leach-Bliley Act (“GLBA”), the Fair Credit Reporting Act (“FCRA”), applicable state insurance laws, or other legal requirements.
Oregon residents may have rights to know, access, correct, delete, and obtain a portable copy of available Personal Data, and to opt out of processing for targeted advertising, sale of Personal Data, or certain profiling decisions, subject to applicable exemptions, limitations, and legal requirements.
Where an exemption applies, Granwest will process and protect such information in accordance with applicable insurance privacy, security, and regulatory requirements.
If we deny an Oregon privacy request and Oregon law provides an appeal right, you may appeal by contacting us using the same request methods and stating that you are submitting an Oregon privacy appeal. If the appeal is denied, we will provide information enabling you to contact the Oregon Attorney General as required by law.
11. Washington, Idaho, and Wyoming Insurance Privacy Notice
For Washington, Idaho, and Wyoming residents, this Privacy Notice is intended to satisfy applicable insurance privacy notice requirements for collection, disclosure, opt-out, confidentiality, security, former-customer information, and consumer rights regarding Nonpublic Personal Information, subject to applicable state-specific requirements and exceptions.
We collect, disclose, and protect Nonpublic Personal Information as described in this Privacy Notice. We do not disclose Nonpublic Personal Information to nonaffiliated third parties in a manner requiring an opt-out unless we provide the required initial notice, opt-out notice, reasonable opportunity to opt out, and any revised notice required by applicable law. If state insurance law provides a right to access or correct recorded personal information, request the reason for an adverse underwriting decision, obtain information about insurance-support organizations, or exercise other insurance privacy rights, Granwest will process such requests in accordance with applicable law.
12. Sensitive Personal Information and Sensitive Data
We collect and use Sensitive Personal Information and Sensitive Data only as reasonably necessary and proportionate for insurance, claims, billing, payment, security, fraud prevention, compliance, legal, or other purposes permitted by law. We do not use Sensitive Personal Information to infer characteristics about a consumer except where permitted by applicable law and reasonably necessary for a disclosed insurance, security, fraud-prevention, compliance, or operational purpose.
Where required by applicable law, we will obtain consent before collecting or processing sensitive data, such as precise geolocation, biometric information, certain health-related information, or personal data of children or teens, unless an exception applies. Insurance policies and claims may require information about minors, household members, dependents, passengers, injured persons, beneficiaries, or other individuals. We collect and use such information only as reasonably necessary for insurance, claims, legal, fraud-prevention, safety, service, or compliance purposes and as permitted by law.
13. Cookies, SDKs, Analytics, and Opt-Out Preference Signals
We and our service providers may use cookies, pixels, SDKs, local storage, analytics tools, security tools, device identifiers, and similar technologies to operate and secure our websites and applications, authenticate users, prevent fraud, maintain system integrity, improve functionality, and understand how users access and interact with our services.
These technologies are used primarily for internal business purposes, including authentication, security, fraud prevention, performance monitoring, and service improvement. For example, limited information such as IP address data may be used to support cybersecurity and fraud-prevention activities and is retained for limited periods consistent with those purposes.
We do not use cookies, SDKs, or similar technologies for cross-context behavioral advertising, and we do not sell or share information collected through these technologies with third parties for advertising purposes.
Where required by applicable law, we will provide notice and obtain consent before using certain categories of cookies or similar technologies. You may manage cookies through your browser settings, device settings, application permissions, or cookie preference tools where available. Disabling certain technologies may affect the functionality, performance, or availability of certain services.
14. Automated Processing, Analytics, and Human Review
Insurance underwriting, rating, fraud prevention, claims handling, billing, payment processing, security, and digital service operations may involve rules-based systems, analytics, vendor tools, risk models, estimating platforms, or other automated or semi-automated processes. These tools may support decisions, generate estimates, identify discrepancies, detect fraud indicators, route work, support operational review, or assist with service delivery.
These tools are intended to support Granwest’s operations and do not replace human judgment where human review is required by law, policy, or internal standards. Any estimate, recommendation, score, alert, or output generated through a tool is for informational, operational, or assistive purposes and does not by itself constitute a coverage determination, claim decision, settlement decision, underwriting decision, cancellation decision, nonrenewal decision, or guarantee of outcome.
Final insurance decisions remain subject to applicable insurance laws, rating plans, underwriting rules, claim-handling standards, adverse action notice requirements, policy terms, and human review where required.
15. Record Retention
We retain Personal Information and Nonpublic Personal Information for as long as reasonably necessary and proportionate to fulfill the purposes described in this Privacy Notice and to support our legitimate business, insurance, operational, legal, and regulatory obligations. Retention periods may vary depending on the nature of the information, the type of product or service involved, policy status, claim status, payment status, litigation obligations, regulatory expectations, tax and accounting requirements, fraud-prevention needs, operational needs, and the sensitivity of the information.
We may retain information as reasonably necessary to provide insurance products and services, quote, underwrite, issue, renew, service, reinstate, cancel, or nonrenew policies, administer claims and litigation, process payments and billing activities, investigate and prevent fraud or unauthorized activity, comply with legal and regulatory obligations, respond to complaints, subpoenas, audits, investigations, and market conduct examinations, maintain actuarial, financial, and operational records, resolve disputes, enforce agreements, and protect our rights, property, systems, operations, employees, customers, and other persons.
When Personal Information or Nonpublic Personal Information is no longer reasonably required for these purposes, we will take reasonable steps designed to securely delete, destroy, anonymize, aggregate, de-identify, archive, or otherwise dispose of the information in accordance with applicable law, regulatory requirements, records-management practices, and information-security obligations.
16. Security and Safeguards
We maintain administrative, technical, and physical safeguards designed to protect Personal Information and Nonpublic Personal Information against unauthorized access, disclosure, misuse, alteration, destruction, or other improper use. Our safeguards are designed to align with applicable federal and state legal requirements, including GLBA Safeguards Rule obligations, applicable state insurance information security requirements, and other applicable privacy and cybersecurity laws.
Our safeguards include controls and processes designed to support the confidentiality, integrity, availability, and resiliency of our systems and information. These measures may include access controls, authentication requirements, authorization procedures, least-privilege access principles, encryption or other protective measures where appropriate, security monitoring, logging, vulnerability management, incident response, disaster recovery, business continuity, employee training, confidentiality obligations, access reviews, physical security measures, and vendor-management processes.
Although we use safeguards designed to protect information, no website, mobile application, payment system, text message, email system, network, cloud environment, or electronic storage system can be guaranteed to be completely secure. You are responsible for using reasonable precautions when interacting with electronic services, including maintaining strong passwords, protecting devices, avoiding insecure networks, and promptly notifying us of suspected unauthorized account activity, suspicious communications, or potential security incidents.
17. How to Submit Privacy Requests
Depending on your state of residence, relationship with us, and applicable legal exemptions, you may have rights to access, know, correct, delete, obtain a copy of, restrict, limit, opt out, appeal, or otherwise exercise choices regarding your information. Insurance, claims, fraud-prevention, legal, regulatory, GLBA, FCRA, and recordkeeping exemptions may limit or modify these rights.
You may submit a privacy request by contacting Granwest Insurance, Privacy Request, 200 Cedar Street, Seattle, WA 98121, by emailing privacy-request@granwest.com, or by using any privacy request webform or portal we make available. We may need to verify your identity, residency, relationship to us, and authority to act before fulfilling a request. Verification may require policy information, claim information, contact information, signed authorization, or other information reasonably necessary to protect against unauthorized access, deletion, correction, or disclosure.
Where applicable law allows an authorized agent to submit a request, we may require proof of authorization and may also require the consumer to verify their identity directly with us unless an exception applies. If we deny a request and applicable law provides an appeal right, you may appeal by using the same contact methods and stating that you are submitting a privacy appeal. We will respond within the timeframe required by applicable law and provide regulator contact information where required.
18. Marketing Choices and Transactional Communications
You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us. You may opt out of marketing text messages by replying STOP where that function is available. Opting out of marketing communications does not stop transactional, policy, billing, claim, security, legal, regulatory, or service communications.
Choices regarding paperless delivery, electronic signatures, push notifications, text messages, online payment services, and other digital services are governed by the applicable portions of these Terms, in addition to this Privacy Notice. Withdrawal of consent or opt-out from a particular communication channel may affect your ability to use certain digital services, but it does not cancel your insurance policy, waive any premium owed, change any coverage obligation, or affect any rights or obligations under your policy or applicable law.
PART III – MOBILE APPLICATION, SMS/TEXT MESSAGING, PUSH NOTIFICATIONS, AND ELECTRONIC COMMUNICATIONS
1. Mobile Application Terms
If Granwest makes a mobile application available to you, the application is considered part of our digital services and is subject to these Terms. Subject to your compliance with these Terms, Granwest grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use the mobile application solely for your personal, non-commercial use and only on a device that you own or control.
The mobile application may allow you to access policy information, billing information, insurance identification cards, claim information, payment features, account information, documents, notices, digital communications, photos, claim submissions, repair information, or other services. Available features may vary by state, product, policy type, account status, device, operating system, application version, network, vendor availability, or other factors.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code, interfere with, disrupt, bypass security for, or misuse the mobile application or any related functionality. You may not use the mobile application for unlawful, fraudulent, unauthorized, or commercial purposes or in a manner that violates these Terms.
2. App Store Terms
If you download the mobile application from the Apple App Store, Google Play Store, or another app marketplace, your use may also be subject to the terms, rules, and policies of that marketplace. Those terms are between you and the applicable marketplace provider, not between you and Granwest. To the extent these Terms conflict with applicable marketplace terms, the marketplace terms may control solely with respect to your use of the marketplace or the downloaded copy of the application.
If you download or use the mobile application on an Apple-branded device, these Terms are between you and Granwest, not Apple Inc. Apple is not responsible for the mobile application or its content and has no obligation to provide maintenance or support services. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the mobile application. Granwest, not Apple, is responsible for addressing claims relating to the mobile application or your possession or use of the application, including product liability claims, claims that the application fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar laws. If the application or your use of it allegedly infringes a third party’s intellectual property rights, Apple is not responsible for investigating, defending, settling, or discharging the claim. Apple and its subsidiaries are third-party beneficiaries of these Terms solely with respect to your use of the mobile application on Apple-branded devices and may enforce those provisions as applicable.
3. Push Notifications
If you enable push notifications, alerts, or similar device-based messages, you authorize Granwest and its service providers to send notices, reminders, alerts, confirmations, service messages, billing messages, claim messages, policy messages, fraud-prevention messages, security messages, and other communications to your device. You may disable push notifications through your device settings or application settings. Disabling push notifications may affect your ability to receive timely alerts or use certain features, but it does not cancel your policy, waive any payment obligation, or change your responsibilities under any policy, billing plan, claim, or applicable law.
4. SMS/Text Messaging Consent
If you provide a mobile telephone number to us or opt in to receive SMS, MMS, text messages, short code messages, long code messages, toll-free number messages, or similar mobile messages from us, you authorize Granwest and its service providers to send text messages to that number as permitted by applicable law. Text messages may include service messages, account alerts, billing reminders, payment confirmations, policy notices, claim updates, fraud-prevention messages, authentication codes, security alerts, customer service messages, and, if you separately consent, marketing or promotional messages.
Consent to receive marketing text messages is not required as a condition of purchasing insurance products or services. Consent to receive certain transactional or service-related messages may be necessary to complete a transaction you requested or to provide a service you selected. Message frequency may vary depending on your account activity, communication preferences, policy status, claim activity, billing activity, transaction history, and services you select. Message and data rates may apply. Your mobile carrier is not liable for delayed or undelivered messages, and text messaging may not be available through all carriers or in all locations.
You may opt out of a text messaging program at any time by replying STOP to a text message you receive from us or by using another opt-out method we provide. After you opt out, you may receive a final confirmation message confirming your opt-out. For help, you may reply HELP to a text message you receive from us or contact us using the contact information in these Terms. Opting out of text messages may limit our ability to provide certain alerts or services by text message. Opting out does not cancel your insurance policy, waive any premium owed, cancel any automatic payment authorization, or prevent us from communicating with you through other lawful methods.
You agree to promptly notify us if you change, transfer, deactivate, or stop using a mobile number you provided to us. You are responsible for any failure to notify us that a number is no longer yours. You agree not to provide a mobile number unless you are the subscriber, customary user, or otherwise authorized to provide consent for that number.
5. Electronic Records, Electronic Signatures, and E-SIGN Consent
By using our websites, mobile applications, customer portals, online payment services, electronic signature processes, paperless delivery options, text messaging services, push notification services, or other digital services, you consent to receive communications from us electronically to the extent permitted by law. Electronic communications may include agreements, notices, disclosures, billing statements, payment confirmations, policy documents, claim communications, privacy notices, changes to terms, account notices, legally required disclosures, and other records or communications relating to your policy, account, claim, payment, or use of our services.
We may provide electronic communications by email, text message, push notification, secure message, customer portal, mobile application, website posting, downloadable document, or other electronic method. You agree that electronic signatures, acknowledgments, consents, authorizations, records, notices, disclosures, and communications have the same legal effect as paper documents and handwritten signatures to the fullest extent permitted by applicable law. By selecting “I agree,” checking a box, clicking a button, typing your name, signing electronically, submitting a form, using an electronic signature tool, or otherwise indicating consent electronically, you intend to sign, accept, authorize, or acknowledge the applicable document, transaction, or communication.
To receive, access, retain, and print electronic communications, you must have a device capable of accessing the internet, a current internet browser or mobile application supported by us, an active email account or other electronic address if applicable, software capable of viewing PDF or similar documents if applicable, sufficient electronic storage capacity, and access to a printer or the ability to save electronic records if you wish to keep copies. By consenting to electronic communications, you confirm that you can access, retain, and print or save electronic communications in the formats we provide.
You may request a paper copy of an electronic communication by contacting us. We may charge a reasonable fee for paper copies if permitted by law and disclosed to you. You may withdraw your consent to receive electronic communications by using the method we provide or by contacting us. Withdrawal of consent will become effective after we have had a reasonable opportunity to process your request. Withdrawing consent may affect your ability to access or use certain online, mobile, paperless, payment, or electronic services. Withdrawal does not affect the legal validity or enforceability of electronic communications, signatures, authorizations, or records provided or accepted before your withdrawal became effective.
Notwithstanding your consent to receive electronic communications, Granwest will provide any notices required by applicable insurance law, including but not limited to notices of cancellation, nonrenewal, lapse, reinstatement, or other statutory notices, in the manner required by applicable law.
Electronic delivery preferences do not replace, waive, or modify any legal requirements governing the method, timing, or delivery of such notices.
PART IV – PAYMENTS FROM YOU TO US
1. Premium Payment Services Covered
This Part IV governs payments made by you to Granwest, including premium payments, installment payments, fees, and other billing-related transactions. These provisions apply to all payment services used to satisfy amounts owed under your insurance policy, billing statement, installment plan, or related agreement.
Granwest may make payment services available through our website, mobile application, customer portal, telephone payment system, authorized payment vendor, recurring payment program, automatic payment plan, guest payment function, or other electronic payment method. Payment methods may include debit card, credit card, checking account, savings account, automated clearing house transfer, electronic funds transfer, or any other payment method that Granwest or its authorized payment service providers may accept from time to time. We may add, modify, suspend, or discontinue any payment method or payment service at any time, subject to applicable law.
2. Authorization to Make Payments
By submitting a payment, enrolling in automatic payments, or providing payment information to us or to our authorized payment service provider, you represent and warrant that you are authorized to use the payment method provided, that the payment information you provide is accurate, current, and complete, and that your payment does not violate any applicable law, account agreement, cardholder agreement, or other obligation.
You authorize Granwest and its authorized payment service providers to initiate, process, submit, resubmit, and complete payments in the amount and on the date authorized by you or otherwise disclosed to you. You authorize your financial institution, card issuer, or payment provider to debit, charge, transfer, or otherwise process the payment. For one-time payments, your authorization applies only to the specific payment you submit or approve. For recurring or automatic payments, your authorization applies to each scheduled payment until the authorization is cancelled or terminated in accordance with these Terms and applicable law.
3. One-Time Payments, Recurring Payments, and Automatic Payments
You may be permitted to make a one-time payment without enrolling in recurring payments or creating a user account. A one-time payment authorizes Granwest or its authorized payment service provider to charge, debit, or otherwise process the payment method you provide for the payment amount you confirm. A one-time payment is not a continuing authorization for future payments unless you separately enroll in recurring or automatic payments.
If you enroll in a recurring or automatic payment plan, you authorize Granwest and its authorized payment service providers to initiate scheduled payments from your designated payment method in accordance with the payment plan, billing schedule, policy terms, notices, or disclosures made available to you. The amount of each recurring payment may vary if your premium, installment amount, fees, taxes, assessments, policy changes, coverage changes, renewal premium, outstanding balance, or other amounts due change. By enrolling in recurring or automatic payments, you authorize Granwest to charge or debit the amount due under the applicable billing schedule or payment plan. We may provide notice of variable payment amounts as required by applicable law or payment network rules.
4. Payment Timing, Failed Payments, and Fees
Payments may not be credited immediately. Processing times may vary depending on the payment method, financial institution, payment network, payment processor, date and time submitted, weekends, holidays, system availability, and other factors. A payment is not considered received, posted, or accepted until it is actually received and successfully processed by Granwest or its authorized payment service provider. Submitting a payment does not guarantee that the payment will be accepted, processed, or posted before a due date, cancellation date, lapse date, or other deadline.
If a payment is rejected, returned, reversed, declined, dishonored, charged back, or otherwise not completed, your payment obligation remains unpaid. Granwest may, subject to applicable law and policy terms, treat the payment as not received. You are responsible for any amounts due, including any applicable late fees, service fees, returned payment fees, reinstatement charges, collection costs, or other charges permitted by law, your policy, billing plan, or other applicable agreement. Granwest may resubmit or reattempt a failed or returned payment to the extent permitted by applicable law, payment network rules, NACHA rules, card network rules, and any authorization you have provided.
5. Payment Credentials, Cancellation, Confirmations, and Errors
You are responsible for maintaining the confidentiality and security of your account credentials, password, payment information, and any device used to access payment services. Granwest may act on payment instructions submitted using your credentials or payment information unless and until we receive notice of unauthorized use and have a reasonable opportunity to act. You agree to promptly update your payment information if your card, bank account, billing address, expiration date, account number, or other payment information changes.
You may cancel recurring or automatic payments by using the cancellation method made available through the website, mobile application, customer portal, customer service center, or other method we provide. Cancellation requests must be received sufficiently in advance of the next scheduled payment to allow Granwest and its payment service providers a reasonable opportunity to act. A cancellation request received too close to a scheduled payment date may not stop a payment already in process. Cancelling recurring or automatic payments does not cancel your insurance policy, waive any premium owed, change your payment obligations, or prevent cancellation, nonrenewal, lapse, or other action permitted under your policy or applicable law if amounts remain unpaid.
After you submit a payment, you may receive an electronic confirmation, receipt, reference number, email, text message, or other notice. A confirmation means only that your payment instruction or authorization was received. It does not necessarily mean the payment has been finally processed, accepted, posted, or credited. You should retain copies of all payment confirmations and review your bank, card, and billing statements regularly. If you believe a payment was made in error or was unauthorized, you should contact us as soon as possible. Nothing in these Terms limits any rights you may have under applicable law regarding unauthorized electronic fund transfers, billing errors, or payment disputes.
6. Third-Party Payment Service Providers
Granwest may use third-party payment processors, financial institutions, technology providers, vendors, or service providers to facilitate payment services. Your use of a third-party payment platform or payment method may also be subject to that provider’s terms, privacy policy, security practices, and disclosures. Granwest is not responsible for the acts, omissions, delays, errors, availability, security practices, or terms of any third-party payment service provider, financial institution, card issuer, or payment network, except to the extent required by applicable law.
Payment information and related personal information will be collected, used, disclosed, retained, and protected as described in this Privacy Notice and as necessary to process payments, administer billing, prevent fraud, comply with law, maintain records, and provide services.
PART V – PAYMENTS FROM US OR THIRD PARTIES TO YOU OR OTHERS
1. Claim Payment Direction Services
This Part V governs claim-related payment services that allow you to authorize Granwest or third parties to issue payment to you or to another party, such as a repair facility, contractor, lienholder, mortgagee, medical provider, or other service provider, in connection with an insurance claim. These services are separate from premium payment services described in Part IV and apply only in the claim context.
Claim payment direction services may allow you to authorize payment to a third party in connection with an insurance claim. Authorizing payment to a third party does not assign your policy rights or benefits unless expressly agreed in writing. Claim payment direction services are intended for use within the United States only and remain subject to the terms of the applicable insurance policy, claim requirements, settlement documentation, payment instructions, and applicable law.
2. Third party-Supported Claim Payment, Estimating, and Related Services
Certain claim payment, direction-to-pay, photo capture, estimating, mobile image upload, repair information, communication, or claim-related functionality may be provided through, hosted by, integrated with, or supported by third-party service providers, including CCC Intelligent Solutions Inc. (“CCC”), on behalf of Granwest. CCC-supported functionality may involve third-party platforms, data sources, analytics tools, artificial intelligence-based functionality, payment direction services, communication features, or other tools designed to support claim processing, estimation, repair coordination, documentation, and payment direction.
By using these claim-related services, you acknowledge and agree that information you provide, including photos, videos, claim-related details, payment instructions, repair information, communications, contact information, and necessary personal information, may be shared with third-party providers, including CCC, as necessary to provide the requested services, support the claim process, facilitate payment direction, and operate related functionality, consistent with this Privacy Notice and applicable law.
Any estimates, recommendations, outputs, images, calculations, communications, payment-direction functionality, or other services provided through CCC-supported functionality are intended for informational and assistive purposes only. These tools do not replace human judgment and do not constitute a final claim determination, coverage decision, settlement decision, repair authorization, payment guarantee, or guarantee of outcome. All claim decisions, coverage determinations, and payment decisions are made by Granwest in accordance with applicable insurance policies, governing law, claim-handling standards, and internal processes.
You agree not to remove or alter proprietary notices, reproduce or modify any CCC-supported platform or functionality except as permitted, reverse engineer or attempt to extract source code, interfere with the operation of the service, or use the service for unlawful, fraudulent, unauthorized, or commercial purposes. To the extent permitted by applicable law, disputes relating solely to CCC-supported third-party services may be subject to additional dispute resolution terms required by the applicable third-party provider.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY THIRD-PARTY CLAIM PAYMENT, DIRECTION-TO-PAY, ESTIMATING, PHOTO CAPTURE, MOBILE IMAGE UPLOAD, OR RELATED CLAIM FUNCTIONALITY, INCLUDING FUNCTIONALITY PROVIDED BY CCC, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CCC AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, SUCH THIRD-PARTY FUNCTIONALITY. THIS LIMITATION APPLIES ONLY TO THE THIRD-PARTY PROVIDER AND DOES NOT LIMIT ANY OBLIGATIONS OR LIABILITIES OF GRANWEST UNDER AN INSURANCE POLICY OR APPLICABLE LAW.
To the extent CCC provides services described in this Part V, CCC is an intended third-party beneficiary of the provisions in this Part V and may enforce those provisions as applicable to its services. Third-party providers, including CCC, may use cookies, device identifiers, and similar technologies to support functionality, security, fraud prevention, analytics, and service delivery, as described in this Privacy Notice and where required by applicable law subject to user consent.
PART VI – DISCLAIMERS, LIABILITY, INDEMNIFICATION, GOVERNING LAW, CHANGES, CUSTOMER SERVICE, AND CONTACT
1. Accuracy of Content and Informational Nature of Digital Services
Content made available through Granwest digital services is provided for general informational, operational, or service-support purposes. While we strive to provide accurate and current information, we do not warrant the accuracy, completeness, usefulness, availability, or timeliness of any content, screen, tool, estimate, confirmation, message, or data made available through a digital service. Digital content should not be relied upon as the sole basis for making insurance, financial, legal, repair, payment, or other decisions.
Nothing on a website, mobile application, portal, digital service, payment screen, claim tool, or electronic communication constitutes an offer to sell or solicitation to purchase any insurance product in any jurisdiction where such offer or solicitation would be unlawful. Insurance products and services are subject to underwriting, policy terms, eligibility, state availability, and applicable law.
2. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRANWEST DIGITAL SERVICES, INCLUDING WEBSITES, MOBILE APPLICATIONS, CUSTOMER PORTALS, PAYMENT SERVICES, CLAIM TOOLS, TEXT MESSAGING SERVICES, PUSH NOTIFICATION SERVICES, ELECTRONIC COMMUNICATION SERVICES, CONTENT, AND RELATED FUNCTIONALITY, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, COMPATIBILITY, AND RELIABILITY.
WE DO NOT WARRANT THAT ANY DIGITAL SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, CURRENT, COMPATIBLE WITH YOUR DEVICE OR SYSTEM, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY INFORMATION, ESTIMATE, CONFIRMATION, MESSAGE, OR OUTPUT PROVIDED THROUGH A DIGITAL SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR PARTICULAR PURPOSE.
3. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GRANWEST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, VENDORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE ANY WEBSITE, MOBILE APPLICATION, PORTAL, PAYMENT SERVICE, CLAIM TOOL, TEXT MESSAGING SERVICE, PUSH NOTIFICATION SERVICE, ELECTRONIC COMMUNICATION SERVICE, CONTENT, OR THIRD-PARTY FUNCTIONALITY.
THIS LIMITATION DOES NOT LIMIT ANY OBLIGATION OR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW AND DOES NOT ALTER GRANWEST’S OBLIGATIONS UNDER AN INSURANCE POLICY OR APPLICABLE INSURANCE LAW.
4. Indemnification
You agree to defend, indemnify, and hold harmless Granwest and its affiliates, officers, directors, employees, agents, licensors, vendors, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of digital services, your violation of these Terms, your violation of applicable law, your unauthorized use of another person’s information, your unauthorized payment instruction, your unauthorized claim submission, or your violation of any rights of another party.
5. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except to the extent federal law applies or another state’s law is required to apply to a particular insurance policy, claim, consumer right, privacy right, payment transaction, or statutory notice. Any dispute arising out of or relating to these Terms or the use of Granwest digital services shall be resolved in the state or federal courts located in Washington, unless otherwise required by applicable law.
6. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technologies, products, services, vendors, legal requirements, regulatory guidance, or business operations. When we make material changes, we will update the effective date and provide additional notice if required by law. If a change materially affects how we disclose Nonpublic Personal Information or materially changes privacy choices, we will provide any revised notice, opt-out notice, consent request, or other notice required by GLBA, state insurance privacy laws, or other applicable law before applying the change as required.
Your continued use of digital services after updated Terms become effective constitutes acceptance of the updated Terms, except where affirmative consent is required by law.
7. Customer Service, Complaints, and Regulatory Rights
If you have a question, concern, or complaint about your policy, billing, claim, or our digital services, you may contact us using the information provided in the Contact Information section below.
We encourage you to contact us first so we can review and attempt to resolve your concern promptly. We will investigate complaints in accordance with applicable insurance laws and our internal complaint-handling procedures.
If your concern relates to a claim determination, coverage decision, billing matter, or other policy-related issue, you may also have the right to file a complaint with your state insurance regulator. Contact information for your state insurance department is available through the National Association of Insurance Commissioners (NAIC) or your state’s official website.
Nothing in these Terms limits any rights you may have under applicable insurance laws, including the right to request information, file complaints with regulators, or pursue remedies available under law.
